SECTION 1 — Agreement to Terms

By accessing or using www.blinddog-graphics.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Blind Dog Graphics LLC ("we," "us," or "our"). If you do not agree to these Terms, you must not access or use the Site.

Your continued use of the Site following the posting of any changes to these Terms constitutes acceptance of those changes. We reserve the right to update, change, or replace any part of these Terms at our sole discretion.

SECTION 2 — Age Restriction (18+)

You must be at least 18 years of age to use this Site or purchase products or services from Blind Dog Graphics LLC. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are under 18 years of age, you are prohibited from accessing or using the Site. We do not knowingly collect information from individuals under the age of 18.

SECTION 3 — Services

Blind Dog Graphics LLC provides custom gang sheet creation, DTF (Direct-to-Film) transfer printing, and related fulfillment services through www.blinddog-graphics.com. Our services include, but are not limited to:

• Custom gang sheet design and layout services
• DTF transfer printing and production
• Order fulfillment and shipping
• Customer support and technical assistance
• Online ordering and account management tools

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of services.

SECTION 4 — Account Registration

To access certain features of the Site and place orders, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity. You may not use another person's account without permission or create multiple accounts.

SECTION 5 — Payments & Billing

All payments for products and services are processed through the payment platform integrated into the Site. By placing an order, you agree to the following payment terms:

• All prices are listed in U.S. Dollars (USD) unless otherwise stated
• Payment is due in full at the time of order placement
• We accept major credit cards, debit cards, and other payment methods as displayed at checkout
• You authorize us to charge your selected payment method for the total amount of your order, including applicable taxes and shipping fees
• All sales are final unless otherwise stated in our refund or return policy

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity. If your order is cancelled after payment has been processed, we will issue a refund to your original payment method.

You are responsible for any fees charged by your financial institution related to payment processing. We are not responsible for any overdraft fees, insufficient funds fees, or other charges incurred as a result of your purchase.

SECTION 6 — Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
• Impersonate or attempt to impersonate Blind Dog Graphics LLC, our employees, another user, or any other person or entity
• Interfere with or disrupt the Site or servers or networks connected to the Site
• Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
• Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site
• Use any automated system, including but not limited to robots, spiders, or scrapers, to access the Site without our express written permission
• Submit false, misleading, or fraudulent information
• Harass, abuse, or harm another person or entity

We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

SECTION 7 — SMS Messaging Program

By opting in to text message communications from Blind Dog Graphics LLC (program name: Blind Dog Graphics SMS Alerts), you consent to receive the following types of messages:

• Order confirmations (order received, payment confirmed)
• Gang sheet delivery notifications (order shipped, tracking info)
• Production status updates (order in production, order completed)
• Tech support responses to customer inquiries
• Account-related transactional communications
• Marketing messages: promotional offers, discounts on gang sheets, and special deals

SECTION 8 — Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, software, and other materials (collectively, "Content"), is the property of Blind Dog Graphics LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site and its Content for personal, non-commercial purposes only. You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any Content without our prior written consent
• Use any Content for commercial purposes without obtaining a license to do so from us or our licensors
• Remove or alter any copyright, trademark, or other proprietary notices from Content
• Use our trademarks, service marks, or trade names without our prior written permission

Unauthorized use of the Site or its Content may violate copyright, trademark, and other laws and may result in criminal or civil penalties.

SECTION 9 — User-Submitted Content

Users may submit artwork, designs, and other materials ("User Content") to Blind Dog Graphics LLC for gang sheet creation and DTF transfer printing services. By submitting User Content, you represent and warrant that:

• You own all rights to the User Content or have obtained all necessary permissions, licenses, and consents to use and submit the User Content
• The User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
• The User Content does not contain any unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable material
• You have the legal right to grant us the license described below

Blind Dog Graphics LLC does not claim ownership of User Content submitted by you. However, by submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the User Content solely for the purpose of providing our services to you, including creating gang sheets and DTF transfers.

You are solely responsible for ensuring that you have the rights to use all submitted artwork and designs. We reserve the right to refuse to process any User Content that we believe, in our sole discretion, violates these Terms or infringes upon the rights of others. We are not responsible for reviewing User Content for legal compliance and assume no liability for any infringement claims arising from User Content.

SECTION 10 — Limitation of Liability

THE SITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Blind Dog Graphics LLC does not warrant that:

• The Site or services will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the Site or services will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the Site will meet your expectations
• Any errors in the Site or services will be corrected

TO THE FULLEST EXTENT PERMITTED BY LAW, BLIND DOG GRAPHICS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Site or services
• Any conduct or content of any third party on the Site
• Any content obtained from the Site
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

SECTION 11 — Governing Law

These Terms and any dispute or claim arising out of or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Louisiana, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts. You waive any objection to jurisdiction or venue in such courts.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.

SECTION 12 — Modifications

We reserve the right, at our sole discretion, to modify, update, or replace these Terms at any time. Changes will be effective immediately upon posting to the Site unless otherwise stated. We will update the "Last updated" date at the top of these Terms to reflect the date of the most recent revision.

It is your responsibility to review these Terms periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes. If you do not agree to the modified Terms, you must discontinue use of the Site.

For material changes to these Terms, we may provide additional notice, such as by email or through a prominent notice on the Site. However, we are not obligated to provide such notice, and your continued use of the Site constitutes acceptance regardless of whether additional notice was provided.
